Terms and Conditions

1.1 Quoted prices include 35 meters of copper and 50 meters of wiring. Any additional copper or wiring will incur a charge of $50 (including GST) per additional meter.
1.2 Unless specified otherwise, standard quotes do not include wall mounting brackets, poly or concrete slabs, electrical conduit, switchboard upgrades, solid wall/double brick hole penetration, removal and replacement of tin roofing, roof space cable runs, internal wall installations, condensate pumps, scaffolding, or PVC elbows/caps.
1.3 The quoted price is based on the current rebate regulations and the information provided by the Customer. It does not reflect the final installation cost if regulatory changes occur or the actual site conditions differ.
1.4 If there is a change in pricing, notification will be given before work commences, allowing the Customer to decide whether to proceed. Written or recorded verbal confirmation is required for any changes.
1.5 Additional charges may apply for services and materials not included in the quotation. This may involve changes of mind, extra copper piping, wiring, switchboard work, or additional labor beyond the original scope.
1.6 All electrical installations require the property’s wiring and metering to meet current Australian Standards. Additional costs may apply if the property does not comply.

2.1 Installation scheduling may be affected by factors such as stock availability, installer schedules, and material availability.
2.2 Raiz Ventures is not liable for any financial loss or damages resulting from the rescheduling or cancellation of installation.
2.3 If the information provided by the Customer regarding the existing heating unit(s) is inconsistent with on-site observations, the Customer may not qualify for the VEU rebate.
2.4 When decommissioning a gas heater, the plumber is legally obligated to perform a gas leakage test. If leakage is detected, the gas supply must be shut off until repairs are made, at the Customer’s expense.
2.5 If the Customer cancels the installation after decommissioning, Raiz Ventures is not responsible for reinstating the heater, and a service fee of $300 + GST will be charged.
2.6 Raiz Ventures is not liable for paint differences, wall damages, or patching required after removing the existing AC unit.

3.1 The extended labour warranty is conditional upon annual servicing by a licensed refrigeration mechanic. Servicing is at the customer’s expense and proof must be provided when making a claim. The extended labour warranty does not apply to faults arising from lack of maintenance or failure to service the system annually. This warranty is provided in addition to rights under Australian Consumer Law.
3.2 Interest on overdue payments will be applied in accordance with the Penalty Interest Rates Act 1983 (VIC) plus 3%. Unpaid accounts may be transferred to a debt collection agency, resulting in additional fees for the Customer.
3.3 Progress payments may be requested for works in progress. Invoices will be provided in advance.
3.4 95% of payment is expected on the day of completion, prior to commissioning the system.
3.5 If payment is not made on completion, the controller will be removed until final payment is received. Additional charges may apply for reinstalling the controller.
3.6 Warranty claims will only be addressed once 95% of the payment has been made.
3.7 If a warranty issue arises, $200 or 5% of the payment may remain unpaid until the issue is resolved.
3.8 Title to the Goods does not transfer to the Customer until full payment is received.
3.9 Raiz Ventures reserves the right to retake possession of Goods and recover associated costs if payment is not made in full.
3.1 Payment is due immediately upon delivery or installation unless agreed otherwise in writing. No deductions, retentions, or offsets are permitted.

4.1 Assignment of Rebates

The Customer irrevocably agrees to assign to Raiz Ventures or its accredited partners (at Raiz Ventures’ direction) the benefit of all government rebate and incentive scheme payments that can be assigned. The assignment of these rebates will constitute partial payment for the Goods and services provided.
4.2 Customer Obligations

The Customer must take all necessary steps to complete and sign any documents required for claiming the rebates or incentives. Failure to do so may affect eligibility for rebates under the VEU program.
4.3 Eligibility Requirements
To qualify for a quote with a VEU program discount, the Customer declares that:
- They have a working gas heating system in place.
- Their home is older than two (2) years.
4.4 Decommissioning Requirements
- Raiz Ventures is required to decommission the existing ducted gas heater used as the main form of heating at the premises, in line with VEU regulations. This includes capping off the gas supply to the unit, but not removing the unit or its components.
- If the Customer changes their mind about decommissioning the existing gas heating system, they will be fully liable for the non-rebated price of the installation upon completion.
4.5 Removal of Outdoor Unit

If the Customer requests removal of the existing outdoor unit and patching of any resulting hole, a separate quote must be obtained from Raiz Ventures before work commences. Standard pricing is typically $200, but this amount will need to be confirmed.
4.6 Decomissioning / Removal of Indoor Unit
- Raiz Ventures decommissions the indoor unit rendering it inoperable after installing the reverse cycle systme.
- At the customers request, we will remove the indoor unit (if possible) for $400 + GST on the day of installation.
4.7 Declaration of Existing Heating Unit
- The Customer declares that their existing heating unit was not installed for the purpose of decommissioning it under the VEU program to claim incentives.
4.8 Customer Acknowledgement
The Customer acknowledges having received, read, and understood the following documents:
- VEU Code of Conduct – Statement of Rights.
- VEU Space Heating and Cooling Consumer Fact Sheet.
- Victorian Energy Efficiency Target scheme Consumer Fact Sheet.
4.9 Impact of Installation Area

The Customer confirms that the quoted heating and cooling appliances adequately cover the majority of the premises and satisfy the needs of the property.
4.10 Coverage of Premises

The Customer confirms that the quoted heating and cooling appliances adequately cover the majority of the premises and satisfy the needs of the property.
4.11 Accredited Provider

Raiz Ventures has partnered with Green Home Green Planet (ABN 19 137 823 360) to act as the Accredited Provider under the VEU.

5. PHOTOGRAPHY AND MARKETING MATERIAL

Raiz Ventures reserves the right to use photos or videos taken on-site for marketing purposes. Customers can opt out by sending an email request to info@raizventures.com.au.

6. EQUIPMENT INSTALLED

6.1 Condensate pumps should be serviced every three months. Unless otherwise stated, they are not covered under standard warranty.
6.2 Raiz Ventures is not responsible for the manufacturer’s warranty response times.

7. LOCATING UNITS AND OUTLETS

7.1 If the Customer is not present at the time of installation, Raiz Ventures will install units in the most practical location based on site conditions.
7.2 Any requests to change the installation location after work has commenced will incur a relocation fee.

8. WARRANTY PROCESS

8.1 Contact Raiz Ventures with a description, photo, or video of any issues.
8.2 Raiz Ventures cannot guarantee the responsiveness of the manufacturer for warranty claims but will act in good faith to resolve issues.
8.3 Customers must provide an opportunity to resolve any errors or defects before escalating complaints.

9. DISPUTE RESOLUTION

9.1 Raiz Ventures will follow the dispute resolution framework set by the Victorian Energy Upgrades program.
9.2 Raiz Ventures will acknowledge complaints within five business days and attempt to resolve them within 20 business days.
9.3 Both parties agree not to make disparaging statements about each other during and after the dispute resolution process.
9.4 This clause does not restrict the parties from making truthful statements required by law.

10. CANCELLATION OF ORDER PRIOR TO INSTALLATION

10.1 A non-refundable deposit is required to secure the reservation. Cancellations within 10 days of placing the order will result in a full refund. After 10 days, the deposit will be forfeited.
10.2 Raiz Ventures reserves the right to cancel any quote before the delivery and installation of Goods.

11. LIMITATION OF LIABILITY

11.1 Raiz Ventures shall not be liable for any indirect, incidental, or consequential damages, including loss of income or property damage arising from the installation.
11.2 Raiz Ventures’ liability is limited to the extent permitted by law. The Customer agrees that Raiz Ventures acts only as a broker connecting customers with licensed Contractors, who are responsible for installation and warranty.
11.3 Raiz Ventures does not accept responsibility for any installation defects, workmanship, or system failures. The Contractors are solely liable for any claims or warranty issues.

12. BROKER DISCLAIMER

Raiz Ventures acts as a broker only, facilitating connections between the Customer and licensed Contractors. The Contractors are fully responsible for installation and any related services. Raiz Ventures does not guarantee the quality or outcome of the installation.

13. POST-INSTALLATION

13.1 The Manufacturer’s warranty is limited to five years for the product and one year for labor.
13.2 Customers are responsible for regular maintenance as per the manufacturer’s recommendations.
13.3 Any promotional gifts are only available after full payment is received.

14. CUSTOMER RESPONSIBILITIES

14.1 The Customer is responsible for providing accurate and complete information regarding the property and any existing HVAC systems. Raiz Ventures is not liable for issues arising from inaccurate or incomplete information provided by the Customer.
14.2 The Customer must ensure that the installation site is accessible, safe, and free from hazards.

15. SITE CONDITIONS

15.1 Raiz Ventures is not responsible for pre-existing site conditions, including structural issues, asbestos, or other hazardous materials discovered during installation.
15.2 The Customer agrees that Raiz Ventures is not liable for any damage caused by drilling, cutting, or alterations required for installation.

16. LIMITATION ON CLAIMS

16.1 Any claims for defects or issues must be reported within 30 days of installation. Raiz Ventures is not liable for any claims made after this period, except as required by law.

17. MANUFACTURER LIMITATIONS

17.1 Raiz Ventures is not responsible for the performance or reliability of any equipment installed, as these are covered by the manufacturer’s warranty.

18. THIRD-PARTY SERVICES

18.1 If Raiz Ventures engages third-party services (e.g., electricians, plumbers), the Customer agrees that Raiz Ventures is not responsible for the quality or outcome of those services.

19. COMPLIANCE WITH LOCAL LAWS

19.1 The Customer is responsible for ensuring compliance with all local regulations, permits, and requirements.

20. NO GUARANTEES

20.1 Raiz Ventures does not guarantee energy savings, system efficiency, or performance outcomes.

21. INDEPENDENT CONTRACTOR RELATIONSHIP

21.1 The Contractors are independent professionals, not employees of Raiz Ventures.

22. AMENDMENTS TO TERMS AND CONDITIONS

22.1 Raiz Ventures reserves the right to update or amend these Terms and Conditions.

23. WAIVER OF LIABILITY FOR CONSEQUENTIAL DAMAGES

23.1 Raiz Ventures is not liable for any consequential, incidental, or indirect damages.

24. RIGHT TO REFUSE SERVICE

24.1 Raiz Ventures reserves the right to refuse service if the site is deemed unsuitable.

25. INDEMNIFICATION

25.1 The Customer agrees to indemnify, defend, and hold harmless Raiz Ventures, its affiliates, employees, agents, and Contractors from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

a. Any warranty issues, defects, or failures associated with the HVAC system or services provided by Contractors or third parties introduced by Raiz Ventures;
b. Any damages to the Customer’s property or to third-party property that occur during or after the installation, except where caused by Raiz Ventures’ gross negligence;
c. The Customer’s failure to provide accurate or complete information regarding the property or existing HVAC systems;
d. The Customer’s failure to maintain the installed HVAC system in accordance with the manufacturer’s guidelines or local regulatory requirements;
e. Any claims, penalties, or fines resulting from non-compliance with local laws, permits, or regulatory requirements;
f. Any actions or inactions of third-party service providers engaged by the Customer without Raiz Ventures’ involvement.

25.2 The indemnification obligation extends to any claims brought by third parties, including but not limited to neighbors, tenants, or governmental authorities, as a result of the services performed or the HVAC system installed.

25.3 The Customer’s indemnification obligations will survive the termination or completion of this Agreement.

26. PRIVACY POLICY

26.1 Any contact information including but not limited too email addresses and phone numbers submitted by The Customer through Raiz Venture’s websites or online advertising material may be used to contact the customer regarding the installation of the relevant products offered by Raiz Ventures.
26.2 Raiz Ventures reserves the right to record any phone calls or other forms of virtual meeting (such as Zoom meetings or Google Meets meetings) for internal training purposes and security reasons.
